Pursuant to California Water Code Section 35004, every voter, or legal representative, may vote at any district election or by a person duly appointed as proxy.
“Voter” means a person who is a holder of title. (Water Code 34027)
“Holder of title” means the owner of record of the fee title to land; provided, however, in the event the owner of record of such fee title has conveyed the equitable title to such land by way of a land sale contract and such contract or memorandum thereof is recorded, “holder of title” shall mean the contract vendee thereunder and not the record owner of the fee title. (Water Code 34026)
“Landowner” or “owner of land” means any of the following:
A person or persons shown as the owner of land on the last equalized assessment roll prepared by the county at the time determination is required to be made pursuant to the requirements of this division. Where that person or persons are no longer the owner, the landowner or the owner of land is any person or persons entitled to be shown as the owner of land on the next equalized assessment roll.
Where land is subject to a recorded written agreement of sale, any person shown in the agreement as the purchaser.
Any public agency owning land other than highways, rights-of-way, easements, waterways, or canals. (Government Code 56048)
“Legal Representative” means either of the following:
A duly appointed and acting guardian, executor, or administrator of the estate of a holder of title to land.
A person duly authorized to act for, and on behalf of, a holder of title to land that is not a natural person. (Water Code 34030)
Each voter shall be entitled to cast one vote for each dollar’s worth of land to which he or she holds title. (Water Code 35003)
Before a legal representative votes at a district election he/she shall present to the precinct board a certified copy of his/her authority which shall be kept and filed with the returns of the election. (Water Code 35006)
